Six Supreme Court rulings that defined September

In September, the Chilean Supreme Court issued a series of particularly significant rulings, addressing matters as diverse as the confidentiality of commercial information held by concessionaires under the Transparency Act, the interruption of the statute of limitations, compensation for breach of contract, acquisitive prescription against registered title, and agreements among unregistered shareholders.

In this month's Case Law Bulletin, we have compiled six of these decisions and discussed their relevance for clients and legal teams.

Among the topics covered:

  • Transparency vs. Commercial Confidentiality in Concessions.
  • Interruption of the statute of limitations.
  • Damages for breach of contract: independent cause of action and interest from the date of service of the complaint.
  • Registered possession: There is no acquisitive prescription against a registered title.
  • Valid criticism in an appeal: it is not enough to argue that the ruling is illogical.
  • Corporations: Unregistered Shareholder Agreements and Acts of the Company Itself.
